Dessert Boxes Terms of Service

Welcome to Dessert Boxes. These terms apply to your use of www.dessertboxes.com.au and to any order you place with us. Dessert Gift Boxes Pty Ltd (25667194998), (“we”, “us”, “our”), trading as Dessert Boxes, operates this website. By browsing the site or placing an order, you agree to these terms. Please read them together with our Privacy Policy, Returns & Refund Policy and Shipping & Delivery Policy, which form part of these terms.
1. Ordering
When you place an order you agree to give us accurate details for yourself and the recipient, including a valid mobile number and email so we can contact you about the order. You are responsible for the accuracy of the delivery address and any gift message. You are responsible for the content of your gift message; we may decline or edit a message that is unlawful or offensive. We may decline or cancel an order — for example where we suspect fraud, a product is unavailable, or there has been a pricing or description error — and if we do, we’ll contact you and refund any payment for that order.
2. Pricing and payment
Prices are shown in AUD and include GST where applicable. Delivery is charged separately and shown at checkout. We accept all major credit cards as well as Paypal, Afterpay and Zippay (and any other options as allowed by Shopify at our online checkout). By providing payment details you confirm you are authorised to use that payment method. Prices and products may change, and we may correct errors (including after you place an order); if a correction affects your order we’ll let you know and give you the choice to proceed or cancel for a full refund.
3. Delivery
Delivery services, timeframes, cut-off times and fees are set out in our Shipping & Delivery Policy, which forms part of these terms. We deliver to the address you provide, and risk in the goods passes to you (or the recipient) once the gift is delivered to that address. Please see our Shipping & Delivery Policy for how we handle unattended deliveries, incorrect addresses and re-delivery.
4. Changes, substitutions and cancellations
You can cancel or change an order up to 48 hours before the selected delivery date; a $19.95 administration fee applies, and we can’t change an order once it’s in production or with our courier. Where an item is unavailable, we may substitute it with a product of equal or greater value and similar quality, and will contact you first for significant changes. Full details are in our Returns & Refund Policy. Nothing in this clause affects your rights under the Australian Consumer Law.
5. Product information and allergens
We describe our products as accurately as we can, and display images as clearly as we can, but screen colours may vary and props shown are not included unless listed. Some products contain or may have traces of nuts, gluten, dairy or alcohol — please read the product description carefully before ordering, especially where the recipient has allergies.
6. Alcohol
Where a gift contains alcohol, it is sold as a genuine gift (ie accompaniment to a gourmet food or pamper gift) and delivered only to a person aged 18 or over. We or our courier may ask for proof of age on delivery, and we will not leave alcohol unattended. As a gift delivery company, we follow the Hamper Liquor License gift rules which stipulate that no more than 2L of alcohol can be included in any one gift advertised and delivered on our website.
7. Your consumer rights and our liability
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Because our products are often gifts, please note that the person who receives the gift has the same consumer guarantee rights as the person who bought it. Nothing in these terms excludes, restricts or modifies any right or remedy you have under those laws that cannot lawfully be excluded.
To the extent permitted by law, and subject to those non-excludable rights: our liability for a failure to comply with a consumer guarantee is limited, at our option, to re-supplying the goods or paying the cost of re-supply; and we are not liable for loss that was not reasonably foreseeable or that did not arise from our acts or omissions. We do not exclude liability we cannot lawfully exclude.
8. Intellectual property
All content on the site — including images, logos, text and designs — is owned or licensed by us and is protected by intellectual property laws. You may use it for your personal, non-commercial use only, and must not copy, reproduce or distribute it without our written consent.
9. Acceptable use
You agree not to use the site for any unlawful purpose, to introduce malware, to scrape or harvest data, to infringe others’ rights, or to interfere with the site’s security or operation. We may suspend access where these terms are breached.
10. Third-party links
Our site may link to third-party websites we don’t control. We’re not responsible for their content, products or privacy practices; please review their terms before using them.
11. Privacy
We handle your personal information in accordance with our Privacy Policy, which forms part of these terms.
12. Events outside our control
We are not responsible for delays or failures caused by events beyond our reasonable control (for example extreme weather, natural disaster, industrial action, or courier or supply failures). This clause does not limit your rights under the Australian Consumer Law.
13. General
We may update these terms from time to time; the version in force when you place your order applies to that order. If any term is found to be unenforceable, the remaining terms continue to apply. These terms are governed by the laws of South Australia, Australia, and you submit to the courts of that place. These terms, together with the policies referred to in them, are the entire agreement between us about your order.
